Employees, contractors or outsourcing: structuring a team in Albania
Three forms, three risk profiles, three levels of control. The wrong choice does not show in year one — it shows when something goes wrong.
Direct employment
Hiring requires an Albanian company and brings employer obligations: contributions, monthly filings, leave and termination rules. In exchange it gives maximum control over how work is organised, full ownership of the output and the strongest ability to retain people. It is the right form where the activity is ongoing, embedded in company processes and directed by the client.
Independent contractors
Working with independent professionals is legitimate and useful where the relationship is genuinely independent: defined scope, organisational autonomy, no fixed hours and no hierarchical subordination. It is not an alternative form for the same activity: using it to disguise employment invites reclassification, with contribution recovery and penalties. It is the risk foreign companies most often underestimate, because practice in their home country may differ.
Outsourcing to a vendor
Handing a scope of work to a local company transfers operational risk and employer obligations to it. It is efficient for standardisable functions and closed-scope projects, and lets you start without setting up your own entity. The price is a weaker grip on know-how and dependency on a vendor: if the outsourced function becomes central to the product, the question of bringing it back in-house eventually arrives.
How to choose, in practice
Three questions settle most cases. Is the activity directed by you day to day, or delivered against a result? Are the skills involved central to your product or ancillary? Is the horizon a project or a permanent capability? Directed activity, central skills and a long horizon point to direct employment; the opposite profile points to outsourcing. Independent contracting covers genuinely independent cases, not the ones in between.
